POLICIES
Terms of Service
Last updated: October 11, 2026
These Terms of Service apply to services provided by PNW Aerial Media (“we,” “us,” or “our”). By approving a quote, paying a booking fee, or otherwise confirming a project, you (“the customer”) agree to these terms and the project details confirmed in writing.
1. Services and project scope
Services may include aerial photography, aerial video, property and land imagery, editing, and related deliverables. The quote or written project confirmation will describe the agreed scope, price, location, deliverables, and estimated delivery timeframe.
Quotes are valid for three months from the date they are issued unless a different validity period is stated in writing. Work outside the agreed scope may require an updated quote and additional payment. Additional charges must be disclosed and approved before the additional work begins.
2. Booking fees, prices, and payment
All prices are quoted in United States dollars (USD). Each project requires a booking fee in the fixed amount stated in its quote or invoice. The booking fee is additional to the package price and is not credited toward the package balance.
The booking fee is due after the project price has been agreed upon and the project agreement has been signed. The booking is not confirmed until the required booking arrangements have been completed.
The remaining package balance is due before the release of the full-quality final photos, videos, or other final deliverables. We may withhold full-quality files while an invoice remains unpaid.
Applicable taxes will be charged when required by law. Travel costs will be included in the quoted price unless the quote expressly states otherwise. Any other additional charges will be disclosed before the customer approves the project.
Invoices may be issued through Stripe, Zoho Invoice, or another service identified on the invoice. Payments are processed through the payment provider offered for the transaction. Payment information is handled according to the applicable provider's terms and privacy practices; we do not intend to store full payment-card details directly.
3. Scheduling and access
Project dates and delivery estimates depend on location access, weather, airspace restrictions, operational safety, equipment availability, and other relevant conditions. A date is not confirmed until we have accepted the booking and the required booking fee has been paid.
The customer must provide accurate project details, a reliable contact method, and sufficient information to identify the property or requested subject.
4. Customer responsibilities and permissions
The customer is responsible for obtaining permission to access or photograph private property and for securing any permissions, approvals, or releases that are their responsibility. The customer must disclose relevant hazards, access restrictions, privacy concerns, and site rules before the project.
We will not conduct a flight when we determine that weather, airspace, people, property, equipment, or other conditions make it unsafe or unlawful. Customers cannot require us to violate applicable laws, FAA requirements, airspace restrictions, or safety procedures.
We will obtain required airspace authorizations and permits that are our responsibility. If a required authorization or permit cannot be obtained and the project therefore cannot legally proceed, the customer will receive a full refund, including the booking fee.
5. Weather, safety, and rescheduling
Drone operations depend on suitable weather and safe, lawful flight conditions. We may delay, reschedule, modify, or cancel a flight if conditions are unsuitable or circumstances prevent us from safely completing the project.
If we cannot proceed because of weather, safety concerns, or another operational issue, the customer may choose to reschedule or receive a refund. If a required permit or authorization cannot be obtained, the full-refund provision in Section 4 applies.
Customer cancellations and other cancellation situations are governed by our Cancellation Policy andRefund Policy.
6. Delivery, revisions, and raw files
The quote or written project confirmation will identify the expected deliverables, file formats, delivery method, and estimated turnaround time. Delivery estimates may change if weather, access, safety, or other circumstances outside our reasonable control affect the work.
One round of reasonable revisions is included when applicable to the quoted service. Revisions must remain within the original project scope. Additional revisions, substantial changes, or newly requested work may incur additional charges, which will be approved before that work begins.
Raw photos, unedited footage, and project files are not included unless agreed otherwise. Available raw files may be provided upon request for an additional fee of $50. Availability, delivery method, and any different fee must be confirmed in writing before payment.
We generally retain project files for up to one year unless otherwise agreed. We do not guarantee indefinite storage or future recovery of files. Customers are responsible for downloading and backing up delivered files.
7. Copyright and permitted use
Unless a different arrangement is agreed to in writing, PNW Aerial Media retains copyright and ownership of the original photographs, video footage, and project files created for a project. Payment for a project does not, by itself, transfer copyright ownership to the customer.
The customer's permitted use of the final deliverables will be specified in the quote or written project agreement. Any expanded license, exclusive rights, copyright transfer, or other special usage arrangement must be agreed to in writing, and the quoted price will reflect the additional rights granted.
Unless otherwise agreed in writing, the customer may use the final delivered files for the personal, business, promotional, or commercial purposes covered by the agreed license. The customer may not resell the images or footage as standalone files or sublicense them for resale unless expressly permitted in writing.
Customers who require particular ownership, licensing, exclusivity, or usage rights must discuss those requirements before approving the quote so that the agreement and price can reflect them.
8. Portfolio and promotional use
Unless the customer requests otherwise, we may display selected completed work in our portfolio, on our website, and in our marketing. Customers who do not want their project used for portfolio or promotional purposes must tell us before the project begins and confirm the restriction in writing.
9. Cancellations and refunds
If the customer cancels at least 24 hours before the scheduled project time, the booking fee will be refunded. If the customer cancels with less than 24 hours' notice, the booking fee will not be refunded, subject to applicable law and any written exception agreed by us.
Once the work has been completed, payments are nonrefundable except in special cases approved by us or where a refund is required by law. Any refund consideration will take account of the circumstances and work completed. The permit-related full-refund provision in Section 4 and the weather and operational provisions in Section 5 also apply.
Further details are available in ourCancellation Policy andRefund Policy. If those policies conflict with these terms, any applicable legal requirement takes precedence.
10. Privacy
Our handling of contact details, project information, and payment-related information is described in ourPrivacy Policy.
11. Limitations and changes
We will perform services with reasonable care, but photography and drone operations depend on conditions that may limit the results. We cannot guarantee a particular view, weather condition, property condition, or outcome that depends on factors outside our reasonable control.
Nothing in these terms excludes or limits rights or remedies that cannot legally be excluded or limited. Changes to the agreed project scope or any special arrangement must be confirmed in writing. If a provision of these terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
